Legal Commentary & Landmark Judgments: Section 451

Section 451 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 411 of the CrPC, 1973) regulates the making over and withdrawal of cases by Executive Magistrates (District Magistrates and Sub-Divisional Magistrates).

  • DM & SDM Powers: Any District Magistrate or Sub-Divisional Magistrate may make over, for disposal, any proceeding which has been started before them to any subordinate Executive Magistrate.
  • Withdrawal & Recall: May withdraw any case from, or recall any case which they have made over to, any subordinate Executive Magistrate, and dispose of it themselves or refer it to another Magistrate.
  • Executive Docket Management: Applies to preventive, public nuisance, and land dispute proceedings under Chapters XI and XII.
Key Landmark Precedents:
  • Madhu Limaye v. SDM Monghyr, (1970) 3 SCC 746: The Supreme Court highlighted that executive proceedings under the Code must maintain administrative transparency and prevent arbitrary transfers.
  • Mathuralal v. Bhanwarlal, (1979) 4 SCC 665: Discussed the administrative authority of the SDM in managing Chapter proceedings regarding breach of peace.
Courtroom Practice & Strategic Litigation Guidance:

When an SDM transfers a contentious Section 148 land dispute to an inexperienced Tehsildar/Executive Magistrate, apply under Section 451 to the District Magistrate to withdraw the proceeding for direct disposal.
