Legal Commentary & Landmark Judgments: Section 41
Section 41 of the Transfer of Property Act, 1882 codifies the doctrine of transfer by an ostensible owner, protecting bona fide purchasers for value who act with reasonable care.
The burden of proving good faith and reasonable care rests entirely on the transferee.
To successfully invoke Section 41, a buyer must establish two distinct elements: (1) that the real owner held out or consented to the transferor acting as ostensible owner; and (2) that the buyer took 'reasonable care' by obtaining Encumbrance Certificates for at least 30 years, inspecting original title deeds, and conducting physical site inspection.
