Legal Commentary & Landmark Judgments: Section 9
Section 9 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 empowers the Tribunal to determine and award monthly maintenance allowances.
In determining the quantum, the Tribunal evaluates the monthly financial requirements of the senior citizen and the economic capacity of the children.
While Section 9 currently incorporates a statutory cap of Rs 10,000 per month (which pending legislative amendment bills seek to remove), Tribunals and High Courts actively interpret the provision in conjunction with Section 4 to mandate adequate medical reimbursement, residential protection, and utility payments in addition to the cash allowance.
