Section 10 empowers the Maintenance Tribunal to alter, modify, increase, or cancel a monthly maintenance allowance upon proof of a material change in circumstances.

  • Material Change in Circumstances Standard: On proof of change in the circumstances of any person receiving or paying monthly maintenance, the Tribunal may make such alteration in the allowance as it thinks fit.
  • Grounds for Upward Revision: Increased cost of living, severe medical illness, hospitalization, or discovery of higher income of the children.
  • Grounds for Reduction / Cancellation: Misrepresentation, substantial loss of income by the child, or death of the recipient.
Key Landmark Precedents:
  • Rajnesh v. Neha (2020) 10 SCC 734: The Supreme Court observed that statutory maintenance orders must remain dynamically responsive to economic inflation and escalating medical costs in old age.
  • Sudesh Chhikara v. Ramti Devi (2022) SCC OnLine SC 1684: Affirmed that Tribunals retain continuous regulatory authority under Section 10 to adjust maintenance awards to contemporary living realities.
Courtroom Practice & Strategic Litigation Guidance:

If a senior citizen's medical expenses surge due to surgery or chronic illness, immediately file an application under Section 10 before the SDM attaching medical bills and hospital estimates, requesting an upward revision of monthly maintenance.
