Section 22 empowers State Governments to confer wide executive powers upon the District Magistrate to implement the Act, authorizing DMs to formulate comprehensive eviction and property protection rules.

  • District Magistrate Supervisory Powers: The State Government may confer such powers and impose such duties on a District Magistrate as may be necessary to ensure that the provisions of this Act are properly carried out.
  • Delegation to Subordinate Officers: The District Magistrate may specify the officer subordinate to him who shall exercise all or any of the powers.
  • Eviction Authority under State Rules: Empowers the formulation of specialized State Rules (such as Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2009) authorizing DMs and SDMs to order the summary eviction of abusive children from parental homes.
Key Landmark Precedents:
  • Sunny Paul v. State (NCT of Delhi) 2018 SCC OnLine Del 11640: The Delhi High Court held that under Section 22 r/w Delhi Rules, the District Magistrate has full jurisdiction to order the summary eviction of an adult son or daughter from the self-acquired property of a senior citizen to ensure peaceful life.
  • S. Vanitha v. Deputy Commissioner (2021) 15 SCC 730: The Supreme Court recognized the eviction power of the District Magistrate under Section 22, while holding that it must not be used to displace a woman possessing shared household rights under the DV Act without due inquiry.
Courtroom Practice & Strategic Litigation Guidance:

When representing an elderly client whose adult son or daughter subjects them to verbal abuse, harassment, or physical intimidation in the parent's house, file a formal eviction petition under Section 22 r/w State Senior Citizen Rules before the District Magistrate/SDM.
