Section 25 of the Recovery of Debts and Bankruptcy Act, 1993 prescribes the coercive modes of recovery available to the Recovery Officer for executing a recovery certificate issued by the Presiding Officer of the Debt Recovery Tribunal (DRT).

  • Attachment and Sale of Properties: Empowers the Recovery Officer to attach and sell the movable and immovable properties of the certificate debtor to satisfy certified bank dues.
  • Arrest and Civil Detention of Debtor: Authorizes the arrest of the debtor and detention in civil prison where the debtor fraudulently concealed or transferred assets to defeat recovery.
  • Appointment of Receiver: Permits the appointment of a court receiver to manage, run, and collect rents and profits from the debtor's commercial properties during recovery.
Key Landmark Precedents:
  • Mathew Varghese v. M. Amritha Kumar (2014) 5 SCC 610: Supreme Court held that recovery officers selling mortgaged properties must ensure wide publicity and 30-day notice to ensure realization of fair market value.
  • Transcore v. Union of India (2008) 1 SCC 125: Supreme Court held that banks may pursue remedies under the RDDBFI Act and SARFAESI Act concurrently without being barred by the doctrine of election.
  • J. Rajiv Subramaniyan v. Pandiyas (2014) 5 SCC 651: Supreme Court affirmed that property sales conducted by recovery authorities without proper valuation and reserve price determination are liable to be set aside.
Courtroom Practice & Strategic Litigation Guidance:

If a Recovery Officer attaches property without issuing a prior 30-day demand notice or without serving the recovery certificate, file an appeal under Section 30 of the Act before the DRT Presiding Officer within forty-five days to stay the auction sale.
