Legal Commentary & Landmark Judgments: Section 485

Section 485 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 441 of the CrPC, 1973) regulates the execution of bail bonds by the accused and their sureties, setting out the terms and conditions guaranteeing appearance.

  • Execution of Bond: Before any person is released on bail or on their own bond, a bond for such sum of money as the police officer or Court thinks sufficient shall be executed by such person.
  • Surety Requirement: When released on bail, one or more sufficient sureties must execute bonds conditioned that the accused shall attend at the time and place mentioned.
  • Continuing Appearance Obligation: The bond binds the accused to appear on every date fixed and whenever called upon by the Court until discharged.
  • Electronic Bonds Permitted: BNSS recognizes the execution of digital bonds and electronically verified surety credentials.
Key Landmark Precedents:
  • Moti Ram v. State of M.P., (1978) 4 SCC 47: The Supreme Court authoritatively held that bail encompasses releasing an accused on their own personal bond without sureties; demanding excessive monetary sureties or insisting on local property owners violates Article 21.
  • Keshab Narayan Banerjee v. State of Bihar, (1985) 3 SCC 677: Held that imposing onerous or impossible bail conditions (e.g., exorbitant cash deposits) amounts to an unconstitutional denial of bail.
Courtroom Practice & Strategic Litigation Guidance:

If a Magistrate insists on local municipal property owners or excessive surety bonds, cite Moti Ram and move an application under Section 485 to accept personal recognizance or outstation family sureties.
