Section 437 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 396 of the CrPC, 1973) governs the disposal of a criminal case by the subordinate court in accordance with the High Court's decision on a reference.

  • High Court's Operative Decision: When a question has been referred to the High Court under Section 436, the High Court shall pass such order thereon as it thinks fit.
  • Transmission of Certified Copy: The High Court shall cause a copy of such order to be sent to the Court by which the reference was made.
  • Disposal in Conformity: The referring Court shall dispose of the case conformably to the said decision of the High Court, and award costs (if any) as ordered.
Key Landmark Precedents:
  • Central Bank of India v. Vrajlal Kapurchand Gandhi, (2003) 6 SCC 573: Affirmed that the subordinate court is strictly bound by the High Court's decision on the reference and cannot reopen the legal question decided.
  • Pranab Kumar Mitra v. State of W.B., AIR 1959 SC 144: Emphasized that judicial discipline requires faithful compliance with the superior court's reference ruling.
Courtroom Practice & Strategic Litigation Guidance:

Once the High Court decides the reference, file an application before the trial court under Section 437 seeking immediate disposal of the pending prosecution in conformity with the ruling.
