Legal Commentary & Landmark Judgments: Section 430

Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023 empowers appellate courts to suspend sentences pending appeal and release appellants on bail.

  • Bail & Custodial Standards: Section 430 provides that pending any appeal by a convicted person, the Appellate Court may, for reasons to be recorded by it in writing, order that the execution of the sentence or order appealed against be suspended and, also, if he is in confinement, that he be released on bail, or on his own bond.
  • Appellate Remedies & Forum: The proviso mandates that when the appeal involves an offence punishable with death or imprisonment for life or imprisonment for not less than ten years, the Appellate Court shall give notice to the Public Prosecutor before releasing the convict on bail.
Key Landmark Precedents:
  • Kashmira Singh v. State of Punjab (1977) 4 SCC 291: The Supreme Court held that where the appellate court cannot hear an appeal within a reasonable time, long incarceration of a convict warrants suspension of sentence and grant of bail; keeping a person in jail pending appeal when they may ultimately be acquitted is an injustice.
  • Atul Tripathi v. State of U.P. (2014) 9 SCC 177: Affirmed that in serious offences, affording an opportunity to the Public Prosecutor to show cause in writing is a mandatory statutory prerequisite before granting bail under Section 389 CrPC (Sec 430 BNSS).
Legal Commentary:

Section 430 is the most vital interim remedy during criminal appeals. In cases where the substantive sentence is fixed-term (under 7 or 10 years) or where appellate delays span years, courts routinely grant bail under Section 430 unless exceptional aggravating circumstances are shown.
