  • Summary Trial Petty Fine: No appeal lies where in a summary trial the fine imposed does not exceed two hundred rupees.
Key Landmark Precedents:
  • State of Mysore v. Shiva, 1969 Cri LJ 1024: Held that petty offence restrictions are intended to prevent clogging appellate courts with trivial monetary penalties.
  • P.K. Ghosh v. J.G. Rajput, (1995) 6 SCC 744: Affirmed that where an appeal is barred under petty cases provisions, a revision petition under Section 397/401 CrPC (Section 438/442 BNSS) remains maintainable to correct jurisdictional errors.
Courtroom Practice & Strategic Litigation Guidance:

Where an appeal is barred by Section 417 due to a minimal fine, file a Criminal Revision under Section 438/442 BNSS if the conviction involves moral turpitude or impacts public employment.
