Legal Commentary & Landmark Judgments: Section 367

Section 367 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 328 of the CrPC, 1973) prescribes the mandatory procedure when a Magistrate holding an inquiry has reason to believe that the accused is a person of unsound mind and consequently incapable of making their defence.

  • Inquiry into Unsoundness of Mind: The Magistrate must inquire into the fact of unsoundness of mind and cause the accused to be examined by the civil surgeon or designated medical officer.
  • Medical Examination & Civil Surgeon Deposition: The civil surgeon or medical expert must be examined as a witness; their report alone does not suffice without judicial examination.
  • Postponement of Proceedings: If the Magistrate finds the accused of unsound mind and incapable of making a defence, the Magistrate must postpone further proceedings in the case.
Key Landmark Precedents:
  • State of Maharashtra v. Sindhi, (1975) 1 SCC 347: The Supreme Court ruled that conducting a trial against a person incapable of understanding proceedings violates Article 21; holding an inquiry under Section 328 CrPC is a mandatory condition precedent.
  • Bapu v. State of Rajasthan, (2007) 8 SCC 66: Held that medical insanity must be distinguished from legal insanity; Section 328 CrPC deals with present mental capacity to defend the trial.
Courtroom Practice & Strategic Litigation Guidance:

If a client exhibits acute cognitive impairment, psychosis, or dementia, file an application under Section 367 supported by medical records requesting immediate medical examination by a civil surgeon before charges are framed.
