Legal Commentary & Landmark Judgments: Section 273

Section 273 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 250 of the CrPC, 1973) provides a stringent check against vexatious litigation by empowering Magistrates to award compensatory costs against complainants or informants who institute false or frivolous accusations without reasonable cause.

  • Discharge or Acquittal Threshold: The power is triggered when a Magistrate discharges or acquits an accused in a case instituted upon complaint or police information and determines that there was no reasonable ground for making the accusation.
  • Mandatory Show-Cause Notice: Before imposing compensation, the Magistrate must call upon the complainant or informant forthwith to show cause why compensation should not be paid to the accused.
  • Judicial Determination & Recovery: The Magistrate must record and consider the cause shown, record reasons for awarding compensation (not exceeding the Magistrate's fine powers), and recover it as if it were a fine, with default simple imprisonment not exceeding thirty days.
Key Landmark Precedents:
  • Prem Chand v. State, 1989 Supp (2) SCC 330: The Supreme Court affirmed that the provisions of compensatory costs serve as a dual deterrent: penalizing frivolous persecutors while compensating innocent citizens subjected to baseless criminal trials.
  • Mohd. Amin v. Jogendra Kumar Bannerjee, AIR 1947 PC 108: The Privy Council established that initiating criminal prosecution without reasonable and probable cause exposes the complainant to statutory compensation as well as civil damages for malicious prosecution.
Courtroom Practice & Strategic Litigation Guidance:

Upon securing a clean acquittal or discharge where allegations are demonstrated to be fabricated or vindictive, defence counsel should immediately move an oral or written prayer urging the Magistrate to invoke Section 273 against the complainant.
