Legal Commentary & Landmark Judgments: Section 166

Section 166 empowers an Executive Magistrate to inquire into disputes concerning any alleged right of user of any land or water, whether such right be claimed as an easement or otherwise, and make orders protecting the exercise of such right (replacing Section 147 CrPC).

  • Right of User Dispute: Dispute concerning right of way, water drainage, pasture, or pathway.
  • Likelihood of Breach of Peace: Magistrate satisfied that dispute is likely to cause public breach of peace.
  • Exercise Within Limitation: Right must have been exercised within three months next before the receipt of information, or during the last season if seasonal.
Key Landmark Precedents:
  • Ramchandra v. Emperor AIR 1939 Pat 342: Held that Section 147 CrPC (Section 166 BNSS) provides a summary remedy to keep common rural pathways and irrigation channels open pending civil adjudication.
  • Municipal Council, Ratlam v. Vardichand (1980) 4 SCC 162: Affirmed the utility of preventive magisterial orders in protecting traditional community water access.
Courtroom Practice & Strategic Litigation Guidance:

Prove that the pathway or drainage channel was actively used within the statutory 3-month window prior to the complaint. Production of electricity tube-well receipts or tractor passage photographs establishes active user.
