Legal Commentary & Landmark Judgments: Section 80

Section 80 of the Arbitration and Conciliation Act, 1996 restricts the role of the conciliator in subsequent proceedings, prohibiting the conciliator from acting as an arbitrator, representative, or counsel in any arbitral or judicial proceedings, and barring them from being presented as a witness.

  • Prohibition on Acting as Arbitrator or Counsel: Unless otherwise agreed by parties, the conciliator shall not act as an arbitrator or as a representative or counsel of a party in any arbitral or judicial proceeding in respect of the dispute that was the subject of conciliation.
  • Absolute Witness Immunity: The conciliator shall not be presented by the parties as a witness in any arbitral or judicial proceedings.
  • Protecting Neutrality & Confidentiality: Ensures that a conciliator who was privy to confidential bottom-line caucusing cannot be weaponized as an adversary or witness in subsequent litigation.
Key Landmark Precedents:
  • Afcons Infrastructure Ltd. v. Cherian Varkey Construction Co. (P) Ltd., (2010) 8 SCC 24: The Supreme Court authoritatively held that Section 80 is vital to maintain public trust in conciliation; a conciliator can never be summoned as a witness or appointed as counsel in subsequent litigation.
  • Haresh Dayaram Thakur v. State of Maharashtra, (2000) 6 SCC 179: Affirmed that the complete detachment of the conciliator from subsequent adversarial proceedings is a mandatory statutory guarantee.
Courtroom Practice & Strategic Litigation Guidance:

If an adversary attempts to appoint the former conciliator as an arbitrator under Section 11 or summon the conciliator to testify regarding settlement talks, move an immediate objection under Section 80 to disqualify the appointment or quash the witness summons.
