Legal Commentary & Landmark Judgments: Section 78

Section 78 codifies the doctrine of postponement of prior mortgagee, establishing that where through fraud, misrepresentation, or gross neglect of a prior mortgagee, another person is induced to advance money on security, the prior mortgagee is postponed to the subsequent mortgagee.

  • Postponement for Misconduct: Where, through the fraud, misrepresentation, or gross neglect of a prior mortgagee, another person has been induced to advance money on the security of the mortgaged property.
  • Priority Forfeiture: The prior mortgagee shall be postponed to the subsequent mortgagee.
  • Gross Neglect Standard: Parting with or failing to obtain original title deeds, enabling the mortgagor to hold himself out as an unencumbered owner and execute a subsequent equitable mortgage.
  • Equitable Punishment for Negligence: Penalizes negligent institutional lenders who leave original title deeds in borrowers' hands.
Key Landmark Precedents:
  • State of Haryana v. Narvir Singh, (2014) 1 SCC 105: The Supreme Court noted that where a prior mortgagee negligently returns or fails to secure title deeds, Section 78 subordinates their claim to a subsequent bona fide equitable mortgagee who took possession of the deeds in good faith.
  • Asset Reconstruction Co. (India) Ltd. v. S.P. Velayutham, (2022) 8 SCC 210: Affirmed that gross negligence under Section 78 operates as an equitable estoppel altering statutory priority.
Courtroom Practice & Strategic Litigation Guidance:

Always obtain and lock original title deeds in the bank's vault; allowing a borrower to retain 'duplicate' original title deeds invites Section 78 postponement against subsequent lenders.
