Legal Commentary & Landmark Judgments: Section 72

Section 72 empowers a mortgagee in possession to spend money for the preservation of mortgaged property, defense of title, and renewal of leases, and to add such expenses to the principal mortgage debt with interest.

  • Preservation Expenses: Mortgagee in possession may spend money: (a) for the preservation of the mortgaged property from destruction, forfeiture, or sale, (b) for supporting the mortgagor's title, (c) for making his own title good against the mortgagor, and (d) for renewal of leases.
  • Capitalization of Expenses: In the absence of a contract to the contrary, money so spent may be added to the principal money at the mortgage rate of interest.
  • Insurance Option: Power to insure building against fire up to two-thirds of value and add premiums to principal.
Key Landmark Precedents:
  • Prithi Nath Singh v. Suraj Ahir, AIR 1963 SC 1041: The Supreme Court noted that Section 72 protects mortgagees in possession who disburse funds to pay property taxes or defend title against trespassers, allowing capitalization upon redemption.
  • Seth Ganga Dhar v. Shankar Lal, AIR 1958 SC 770: Affirmed that legitimate preservation expenses under Section 72 must be accounted for and repaid upon redemption.
Courtroom Practice & Strategic Litigation Guidance:

Preserve all municipal tax receipts, litigation expense vouchers, and repair bills incurred while in possession; these are fully recoverable from the mortgagor under Section 72 upon redemption.
