Legal Commentary & Landmark Judgments: Section 63

Section 63 regulates accessions to mortgaged property during the subsistence of the mortgage, establishing that the mortgagor is entitled to natural accessions upon redemption, and providing rules for acquired accessions.

  • Natural Accessions to Mortgagor: Where mortgaged property in possession of the mortgagee has, during the continuance of the mortgage, received any accession, the mortgagor, upon redemption, shall, in the absence of a contract to the contrary, be entitled as against the mortgagee to such accession.
  • Severable Acquired Accessions: Where accession is acquired at the expense of the mortgagee and is capable of separate possession without detriment, the mortgagor desiring it must pay the cost; if not desired, the mortgagee may remove it.
  • Inseparable Accessions: Where accession is inseparable, mortgagor takes it upon paying the actual cost of acquisition if made to prevent destruction, deterioration, or forfeiture.
Key Landmark Precedents:
  • Nainsukhdas Shivnarayan v. Goverdhandas Girdhardas, AIR 1948 Nag 110: Examined the doctrine of accession under Section 63, holding that alluvion land or statutory tenures acquired by the mortgagee adhere to the mortgaged estate for the benefit of the mortgagor.
  • Murlidhar v. Gaya Prasad, AIR 1954 All 416: Affirmed that accessions acquired by virtue of possession of the mortgaged security inure to the mortgagor upon redemption.
Courtroom Practice & Strategic Litigation Guidance:

If a mortgagee in possession constructs unauthorized structures, assert Section 63 upon redemption to insist that the mortgagee either remove the additions at their own cost or deliver them without demanding inflated compensation.
