Legal Commentary & Landmark Judgments: Section 51
Section 51 of the Transfer of Property Act, 1882 codifies the equitable right of a bona fide holder under a defective title to compensation for improvements made to the property upon eviction.
Section 51 prevents the true owner from reaping an unearned windfall at the expense of an innocent occupant. However, trespassers, tenants, and persons who build during pending litigation with notice cannot claim Section 51 protection.
