Legal Commentary & Landmark Judgments: Section 48
Section 48 of the Transfer of Property Act, 1882 codifies the foundational rule of priority, enacting the maxim 'qui prior est tempore potior est jure' (he who is first in time is stronger in law).
A later transferee cannot acquire a right superior to an earlier transferee, because the transferor has already alienated that quantum of interest.
Under Section 47 of the Registration Act, a registered document operates from the date of its execution, not the date of registration. Consequently, under Section 48 TPA read with Section 47 Registration Act, if Deed A is executed on Day 1 and registered on Day 30, and Deed B is executed on Day 2 and registered on Day 10, Deed A takes priority because it was executed first.
