The following instruments may be stamped with adhesive stamps, namely:—
(a)bills of exchange, and promissory notes drawn or made out of India;
(b)entry as an advocate, vakil or attorney on the roll of a High Court;
(c)notarial acts; and
(d)transfers by endorsement of shares in any incorporated company or other body corporate;
(e)receipts for any payment exceeding five thousand rupees.
Legal Commentary & Landmark Judgments: Section 11
Section 11 of the Indian Stamp Act, 1899 demarcates the exhaustive categories of instruments permitted to be stamped using adhesive stamps, restricting adhesive stamping to low-denomination transactions, foreign-drawn negotiable instruments, notarial acts, and share transfers, while prohibiting its unauthorized extension to major conveyances.
Exhaustive Statutory Catalogue for Adhesive Stamping: Permits adhesive stamps exclusively for: (a) instruments chargeable with duty not exceeding ten naye paise; (b) bills of exchange and promissory notes drawn or made out of India; (c) entry as an advocate, vakil, or attorney; (d) notarial acts; and (e) share transfers by endorsement.
Prohibition on Major Conveyances and Agreements: Conveyances, sale deeds, mortgages, and substantial commercial agreements cannot be stamped with ordinary adhesive stamps; doing so violates Section 11 and constitutes an improper description of stamp under Section 37.
State Amendments & Special Adhesive Stamps: State amendments permit special adhesive stamps, court fee stamps, or judicial stamps under specific administrative rules, provided they are affixed by designated stamp vendors or treasury officers with official serial endorsements.
Key Landmark Precedents:
Ram Narayan v. Ram Kumar (1988) 1 SCC 706: The Supreme Court held that promissory notes and negotiable instruments must strictly comply with Section 11; if adhesive stamps are utilized, they must be of the specific statutory description and properly cancelled at the time of execution.
Madan Lal v. Smt. Gopi (1998) 4 SCC 344: The Supreme Court affirmed that an instrument chargeable with ad valorem duty under Schedule I cannot be stamped with ordinary postage or revenue adhesive stamps unless expressly authorized under Section 11, rendering unauthorized adhesive stamping void for evidentiary admission.
Courtroom Practice & Strategic Litigation Guidance:
In loan recovery suits based on foreign promissory notes or notarial instruments, confirm that the adhesive stamps used fall squarely under Section 11. If an agreement or promissory note was stamped with improper revenue stamps not permitted by Section 11, petition the court immediately under Section 37 for permission to pay the correct duty and obtain Collector certification.
