Legal Commentary & Landmark Judgments: Section 49

Section 49 provides statutory authority and procedure for Marriage Officers to correct clerical, mathematical, or factual errors discovered in the Marriage Certificate Book.

  • Correction of Clerical & Factual Errors: If the Marriage Officer discovers that there is any error in the form or substance of any entry in the Marriage Certificate Book, he may correct the error within one month after discovery.
  • In the Presence of Parties: Corrections must be made in the presence of the persons married, or in the case of their death or absence, in the presence of two credible witnesses.
  • Marginal Note Execution: Correction is effected by making a marginal note without altering the original entry, signed by the Marriage Officer and the witnesses present.
  • Report to Registrar-General: A copy of the marginal correction must be forwarded immediately to the Registrar-General under Section 49(2).
Key Landmark Precedents:
  • Kavita v. State of Maharashtra (2016) SCC OnLine Bom 4512: Held that Section 49 empowers Marriage Officers to rectify spelling mistakes, incorrect dates of birth, or parental names without forcing parties into lengthy declaratory civil suits.
  • Deepak v. State of Haryana (2020) SCC OnLine P&H 1042: Affirmed that substantive alterations affecting the legal identity of the spouses cannot be made casually under Section 49 without formal notice and inquiry.
Courtroom Practice & Strategic Litigation Guidance:

For minor clerical errors in the marriage certificate (such as transposed letters in names or incorrect address numbers), do not file a civil suit for declaration. Move an administrative application under Section 49 before the Marriage Officer with supporting passport or Aadhaar proof.
