Legal Commentary & Landmark Judgments: Section 12

Section 12 regulates the place and procedural solemnization of a marriage under the Special Marriage Act, permitting solemnization at the Marriage Officer's office or other convenient places, and prescribing the mandatory secular marriage formula.

  • Place of Solemnization: The marriage may be solemnized at the office of the Marriage Officer, or at such other place within a reasonable distance therefrom as the parties may desire, upon payment of prescribed fees.
  • Freedom of Form & Secular Formula: The marriage may be solemnized in any form which the parties may choose to adopt; however, each party must say to the other in the presence of the Marriage Officer and three witnesses: 'I, (A), take thee (B), to be my lawful wife [or husband]'.
  • No Religious Rites Required: No religious ceremonies, rituals, or customary sacraments are necessary; the statutory spoken formula creates a binding and irrevocable legal marriage.
Key Landmark Precedents:
  • Shri Rajesh Kumar v. State of Haryana (2018) SCC OnLine P&H 1563: The High Court held that the spoken formula under Section 12(2) is the irreducible essence of a civil marriage; once spoken in the presence of the Marriage Officer and three witnesses, the marriage is legally complete.
  • S. Nagalingam v. Sivagami (2001) 7 SCC 487: Contrasted sacramental Hindu marriages with secular civil unions under Section 12, noting that SMA deliberately dispenses with religious rituals to ensure universal civil access.
Courtroom Practice & Strategic Litigation Guidance:

If parties desire solemnization outside the registrar's office (e.g., at home or a venue), submit a formal requisition under Section 12(1) along with the prescribed travel and inspection fees. Ensure the mandatory spoken declaration is recorded in the official minutes.
