Legal Commentary & Landmark Judgments: Section 2

Section 2 serves as the master interpretation clause of RERA, defining critical statutory terms including 'carpet area', 'promoter', 'allottee', 'common areas', and 'ongoing project', thereby eliminating ambiguities and unilateral builder definitions in real estate transactions.

  • Carpet Area [Sec 2(k)]: Strictly defined as the net usable floor area of an apartment, excluding walls, common areas, and exclusive balconies/verandahs, mandating sale of units exclusively on carpet area.
  • Promoter [Sec 2(zk)]: Comprehensive definition encompassing builders, developers, contractors, development authorities, societies, and land owners who enter into joint development agreements (JDAs) to sell plotted or apartment units.
  • Allottee [Sec 2(d)]: Includes any person to whom a plot, apartment, or building has been allotted, sold, or transferred, but expressly excludes a tenant.
  • Common Areas [Sec 2(n)]: Encompasses the entire land, staircases, lifts, fire escapes, community amenities, installations of central services, and parking spaces, which must be conveyed to the association of allottees.
Key Landmark Precedents:
  • Imperia Structures Ltd. v. Anil Patni, (2020) 10 SCC 783: The Supreme Court held that the remedies available to allottees under RERA are concurrent and in addition to those available under the Consumer Protection Act and NCLT under the IBC.
  • M/s Sana Realtors Pvt. Ltd. v. Union of India, 2022 SCC OnLine Del 4118: Held that land-owning partners entering into Joint Development Agreements (JDAs) fall squarely within the definition of 'promoter' under Section 2(zk) and are jointly liable for statutory obligations.
Courtroom Practice & Strategic Litigation Guidance:

Scrutinize the Builder-Buyer Agreement (BBA) to ensure pricing is strictly pegged to RERA 'carpet area'; any attempt to charge for super area, terrace, or open car parking without separate statutory authorization violates Section 2(k) read with Section 4.
