Act 2016

Legal Commentary & Landmark Judgments: Section 18

Section 18 of RERA confers an unqualified statutory right upon allottees to claim an immediate, full refund of their investment with interest if the promoter fails to complete or give possession of the apartment in accordance with the terms of the agreement for sale.

  • Statutory Relief & Application: Section 18 is the cornerstone relief provision for homebuyers under RERA.
  • RERA Regulatory Governance: Under sub-section (2), the promoter must compensate allottees for defective title to the land, an obligation which is never barred by limitation.

Sub-section (3) provides compensation for failure to discharge any other obligation under the Act.

Key Landmark Precedents:
  • Newtech Promoters and Developers Pvt. Ltd. v. State of U.P. (2021) SCC OnLine SC 1044: The Supreme Court authoritatively held that the right of an allottee to seek refund with interest under Section 18(1)(a) upon failure of the promoter to deliver possession within the agreed period is absolute and unconditional; the Authority or Adjudicating Officer has no discretion to deny refund and force the allottee to accept delayed possession.
  • Imperia Structures Ltd. v. Anil Patni (2020) 10 SCC 783: The Supreme Court held that the remedies available to allottees under Section 18 of RERA are concurrent with and in addition to remedies available under the Consumer Protection Act and IBC; an allottee may choose to approach the Consumer Forum instead of RERA.
  • Pioneer Urban Land & Infrastructure Ltd. v. Govindan Raghavan (2019) 5 SCC 725: The Supreme Court ruled that a buyer cannot be compelled to take possession of a flat that is delayed beyond a reasonable period; the flat purchaser is entitled to an immediate refund of the entire money deposited along with interest at the prescribed rate.
Legal Commentary:

Section 18 dismantled developer arguments relying on force majeure, contractor defaults, or administrative delays. The statutory interest rate prescribed under state RERA Rules (usually State Bank of India highest marginal cost of funds-based lending rate plus two percent) must be awarded automatically from the promised possession date until actual refund or delivery.
