Legal Commentary & Landmark Judgments: Section 29

Section 29 regulates the place of registration for documents not relating to immoveable property, permitting presentation either in the sub-district of execution or any other sub-district where all parties desire.

  • Non-Immoveable Property Instruments: Applies to documents not relating to immoveable property (e.g., partnerships, adoption deeds, movable property hypothecations, simple powers of attorney).
  • Place of Execution Registry: May be presented for registration in the office of the Sub-Registrar in whose sub-district the document was executed.
  • Any Desired Sub-District: May also be registered in the office of any other Sub-Registrar under the State Government at which all the persons executing and claiming desire the same to be registered.
Key Landmark Precedents:
  • Kishore Chand v. Ganesh Prasad, AIR 1954 SC 316: The Supreme Court highlighted the legislative contrast between the strict territorial nexus of Section 28 for immoveable property and the flexible forum permitted under Section 29 for movable instruments.
  • Suraj Lamp & Industries Pvt. Ltd. v. State of Haryana, (2012) 1 SCC 656: Reiterated that transactions involving immoveable property must strictly follow Section 28 and cannot take advantage of Section 29.
Courtroom Practice & Strategic Litigation Guidance:

Ensure that deeds of partnership, trusts of movable assets, or simple general powers of attorney are presented before the local Sub-Registrar where the deed was executed or where all parties consent.
