Legal Commentary & Landmark Judgments: Section 12

Section 12 directs the Central Government to provide the Appellate Tribunal with requisite officers and staff, establishing the administrative registry of the DRAT.

  • Administrative Staffing Obligation: Sub-section (1) commands the Central Government to provide the Appellate Tribunal with such officers and employees (including Registrars, bench clerks, and court officers) as it may think fit.
  • Registry and Judicial Scrutiny: The officers and employees under Section 12 discharge essential functions including registration of appeals, calculation of statutory pre-deposit under Section 20 RDB / Section 18 SARFAESI, and issuance of notice.
  • Superintendence of the Chairperson: Sub-section (2) commands that the officers and employees of an Appellate Tribunal shall discharge their functions under the general superintendence and direction of the Chairperson.
Key Landmark Precedents:
  • Union of India v. Delhi High Court Bar Association (2002) 4 SCC 275: The Supreme Court directed the Central Government to provide adequate administrative staff and financial support to ensure that DRAT registries function efficiently without causing systemic delays in commercial recoveries.
  • State of Maharashtra v. Labour Law Practitioners' Association (1998) 2 SCC 688: The Supreme Court affirmed that tribunal staff discharging registry and quasi-judicial functions must remain strictly subordinate to the judicial head of the tribunal to protect judicial independence.
Courtroom Practice & Strategic Litigation Guidance:

All procedural defects, pre-deposit calculations, and applications for waiver of defects must initially be cleared before the Registrar appointed under Section 12. If a Registrar passes an adverse administrative order refusing to number an appeal or rejecting an application, an appeal/revision lies directly to the Chairperson in Chamber under the DRAT (Procedure) Rules, 1994.
