Legal Commentary & Landmark Judgments: Section 7
Section 7 of the NDPS Act empowers State Governments to appoint enforcement and excise officers with appropriate designations to administer, investigate, and execute the provisions of the Act within their respective state jurisdictions.
In state police or excise interdictions, verify whether the seizing officer (e.g., Sub-Inspector, Excise Inspector) was specifically designated and empowered by a State Government notification under Section 7 r/w Section 42. If the officer lacked gazetted notification status or territorial authorization at the date of seizure, challenge the search and recovery as ultra vires and void ab initio.
