Legal Commentary & Landmark Judgments: Section 19
Breach of sovereign trust by licensed opium poppy farmers is punished with non-discretionary severity under this provision. Where a cultivator holds an official state license under Chapter III to cultivate opium poppy for public pharmaceutical monopolies but embezzles, conceals, or illegally disposes of the harvested opium resin on the illicit black market, the statute imposes mandatory rigorous imprisonment for a term not less than ten years, extendable up to twenty years, along with a mandatory fine of not less than one lakh rupees up to two lakh rupees. The court is further empowered to impose a fine exceeding two lakh rupees upon recording special reasons in the judgment.
This statutory framework establishes clear operational guidelines, balancing legal compliance with procedural safeguards.
Section 19 treats embezzlement by licensed farmers as an offense against the state. The statutory presumption of guilt under Section 54 operates with maximum potency once a discrepancy between the mandated crop surrender quota and actual delivery to the Narcotics Commissioner is demonstrated.
