Legal Commentary & Landmark Judgments: Section 15
Penal sanctions for contraventions involving poppy straw—the residual husk and unlanced or lanced capsules of the opium poppy containing trace morphine alkaloids—are structured across three statutory sentencing tiers based on recovered quantity. Under clause (a), offenses involving small quantity (up to 1,000 grams) attract rigorous imprisonment up to one year, fine up to ten thousand rupees, or both. Under clause (b), intermediate quantities incur rigorous imprisonment up to ten years and fine up to one lakh rupees. Under clause (c), commercial quantity (50 kilograms or more) triggers mandatory minimum imprisonment of ten years, extendable to twenty years, alongside a non-discretionary fine of not less than one lakh rupees up to two lakh rupees.
In Gurdev Singh v. State of Punjab (2021) 6 SCC 788, the apex court emphasized that courts imposing sentences above the minimum ten-year threshold must articulate specific aggravating factors, such as commercial syndication or recidivism under Section 31.
Crossing the 50-kilogram commercial threshold for poppy straw removes judicial discretion regarding minimum sentences and triggers the statutory bail embargo under Section 37. To sustain a conviction, the prosecution must strictly prove representative sampling under Section 52A from each seized bag rather than drawing an aggregate sample from mixed lots.
