Legal Commentary & Landmark Judgments: Section 87

Section 87 of the Motor Vehicles Act, 1988 governs the grant of temporary permits for a duration not exceeding four months, strictly restricting their issuance to four exhaustively defined temporary contingencies and barring their use as a continuous substitute for regular permits.

  • Exhaustive Statutory Grounds: Temporary permits can be granted only for: (a) conveyance of passengers on special occasions such as fairs and religious gatherings; (b) seasonal business; (c) meeting a particular temporary need; or (d) pending decision on an application for renewal of a regular permit under Section 81.
  • Maximum Four-Month Duration: A temporary permit cannot be issued for a duration exceeding four months at any one time under Section 87(1).
  • Statutory Prohibition on Recurring Grants: Section 87(2) expressly prohibits the grant of repeated temporary permits to circumvent regular permit procedures or to circumvent monopoly route nationalisation under Chapter VI.
Key Landmark Precedents:
  • Madhya Pradesh State Road Transport Corporation v. Regional Transport Authority, Raipur (1992) Supp (2) SCC 735: The Supreme Court held that temporary permits cannot be granted under Section 87 on a recurring basis as a continuous substitute for permanent stage carriage permits; doing so violates the statutory scheme and constitutes fraud on the power.
  • A. Viswanathan v. State Transport Appellate Tribunal AIR 1987 SC 731: The Supreme Court affirmed that a temporary permit must strictly relate to a real, transient statutory emergency; the absence of regular permits on a route does not constitute a 'temporary need' under Section 87(1)(c).
Courtroom Practice & Strategic Litigation Guidance:

In challenging temporary permits granted to competitors, establish that the RTA is granting back-to-back 4-month permits to bypass the Section 80 regular permit procedure. Under MPSRTC v. RTA, successive temporary permits are illegal and vulnerable to immediate quashing by the State Transport Appellate Tribunal under Section 89 or Section 90.
