Legal Commentary & Landmark Judgments: Section 81
Section 81 of the Juvenile Justice Act, 2015 imposes severe criminal penalties on the buying, selling, or commercial procurement of children for any purpose whatsoever.
The proviso introduces an aggravated category: where such sale or procurement is committed by a person having actual charge of the child, including the staff or management of a hospital, nursing home, maternity home, or child care institution, the punishment escalates to rigorous imprisonment for a term not less than three years, extendable up to seven years, and a fine. This targets black-market baby trade in healthcare facilities.
Section 81 strikes decisively at illegal child trade. By imposing severe statutory penalties on hospitals, doctors, and institutional caretakers who facilitate illicit transfers, the law creates powerful deterrence against organized baby-selling syndicates that exploit vulnerable mothers.
