Legal Commentary & Landmark Judgments: Section 29
Section 29 of the Juvenile Justice Act, 2015 confers exclusive statutory authority and magisterial powers upon the Child Welfare Committee to dispose of all matters concerning children in need of care and protection.
Sub-section (2) enacts a crucial legal fiction: the Committee shall function as a Bench and shall have the powers conferred by the Code of Criminal Procedure, 1973 on a Metropolitan Magistrate or a Judicial Magistrate of the First Class. This empowers the Committee to issue summonses, conduct judicial inquiries, enforce production of documents, and issue binding care orders.
By equating the Child Welfare Committee to a Judicial Magistrate First Class Bench under Section 29(2), the legislature vested this child protection body with full judicial authority. This allows CWCs to issue binding production warrants, demand institutional accountability, and override resistance from recalcitrant custodians or institutions.
