Legal Commentary & Landmark Judgments: Section 23
Section 23 of the Juvenile Justice Act, 2015 commands a strict statutory prohibition against conducting joint trials or joint proceedings involving a child and an adult co-accused.
Section 23 enacts an absolute statutory bar against joint trials of children and adults, preventing harmful exposure to ordinary adversarial criminal processes.
Section 23 prevents the contamination of child-friendly proceedings by adversarial adult criminal trials. Even when an offence arises from the exact same transaction, the state is statutorily obligated to sever the prosecution, ensuring the juvenile's rights are adjudicated under specialized welfare procedures.
