Legal Commentary & Landmark Judgments: Section 54

Section 54 of the Industrial Relations Code, 2020 provides a summary execution mechanism enabling workers to recover money due from employers under settlements, awards, or Chapters IX/X via revenue recovery certificates issued by the Government to the District Collector for collection as arrears of land revenue.

  • Worker Recovery Application to Government: Worker or authorized representative may file an application before the appropriate Government for recovery of any liquidated sum due under a settlement, award, or lay-off/retrenchment provisions.
  • Issuance of Revenue Recovery Certificate: Upon administrative satisfaction of the debt, the Government issues a certificate to the District Collector, who must recover the sum in the same summary manner as arrears of land revenue.
  • Strict Demarcation from Substantive Adjudication: Operates purely as an executing forum analogous to Order XXI CPC; cannot be invoked to create new entitlements or adjudicate disputed questions of right.
Key Landmark Precedents:
  • Central Bank of India Ltd. v. P.S. Rajagopalan AIR 1964 SC 743: Constitution Bench held that recovery proceedings under industrial law are in the nature of execution proceedings; the adjudicating authority cannot adjudicate fresh rights but merely computes pre-existing entitlements.
  • Municipal Corporation of Delhi v. Ganesh Razak (1995) 1 SCC 235: A 3-Judge Bench held that where the very basis of a worker's claim (such as equal pay for equal work) is disputed by the employer, summary recovery proceedings cannot be entertained without prior industrial adjudication.
  • Punjab National Bank v. K.L. Kharbanda AIR 1963 SC 487: Supreme Court affirmed that monetary benefits capable of computation under pre-existing agreements or awards can be recovered through summary revenue certificates.
Courtroom Practice & Strategic Litigation Guidance:

In recovery applications under Section 54, attach a certified copy of the award or settlement alongside an itemized ledger showing exact monthly wage arrears, dearness allowance calculations, and interest. If the employer raises a bona fide dispute regarding entitlement, file a Section 46 application before the Tribunal rather than pursuing summary recovery.
