Legal Commentary & Landmark Judgments: Section 45

Section 45 of the Industrial Relations Code, 2020 establishes the conclusive finality of Government notifications appointing Judicial or Administrative Members to an Industrial Tribunal, while preserving the validity of tribunal proceedings against technical challenges founded on vacancies or constitutional defects.

  • Absolute Finality of Member Appointments: No notification issued by the appropriate Government appointing any person as a Judicial Member or Administrative Member of an Industrial Tribunal can be questioned in any manner before any court.
  • De Facto Validation of Tribunal Proceedings: No act, hearing, or award of an Industrial Tribunal can be challenged on the ground merely of the existence of any vacancy in, or defect in the constitution of, such Tribunal.
  • Institutional Protection Against Jurisdictional Paralysis: Codifies the de facto doctrine in labour adjudication, preventing litigious employers or unions from frustrating awards through collateral attacks on the technical appointment process.
Key Landmark Precedents:
  • Gokaraju Rangaraju v. State of Andhra Pradesh (1981) 3 SCC 132: Landmark Supreme Court decision affirming the de facto doctrine, holding that acts of judicial officers performed within apparent authority are valid and cannot be collaterally challenged on grounds of defective appointment.
  • Central Bank of India v. Meenakshi Sundaram (1971) 2 SCC 514: Supreme Court held that proceedings before industrial adjudication authorities cannot be invalidated on technical irregularities regarding member tenure or momentary vacancies where statutory validation clauses apply.
Courtroom Practice & Strategic Litigation Guidance:

When resisting a writ petition challenging an adverse Industrial Tribunal award, invoke Section 45 as a complete statutory bar against pleas questioning the qualification or vacancy status of the presiding members. Challenges to appointment validity can only be agitated via independent Quo Warranto writ proceedings, not as an appellate ground against an award.
