Legal Commentary & Landmark Judgments: Section 43
Section 43 governs distribution where the father is dead, enacting that the property is divided equally among the mother, surviving brothers, and surviving sisters.
The section treats the mother and siblings on equal footing: the mother does not exclude the siblings, nor do the siblings exclude the mother. For instance, if an intestate leaves a mother, two brothers, and one sister, the estate is divided into four equal shares (1/4 to mother, 1/4 to Brother 1, 1/4 to Brother 2, 1/4 to Sister). Under Section 27, half-brothers and half-sisters share equally with full-blood siblings.
Section 43 is frequently litigated in estates of young unmarried individuals. If an unmarried professional dies intestate and their father is already deceased, their mother must share the estate equally with the decedent's surviving siblings. Counsel advising surviving mothers must clarify that under Section 43, she cannot claim the entire estate if any brother or sister survives.
