Legal Commentary & Landmark Judgments: Section 32
Section 32 establishes the foundational framework for intestate devolution, declaring that the property of an intestate devolves upon the wife or husband, or upon those of his kindred, in the order and rules set forth in this Chapter.
The devolution is automatic, universal, and strictly regulated by the statutory pecking order enacted in the subsequent sections.
The statutory code recognizes only two categories of statutory claimants: (1) the surviving spouse (widow or widower); and (2) blood relatives (kindred or consanguinity). It firmly excludes strangers, friends, informal dependents, and relatives by marital affinity (in-laws, step-relations). The rights created by this section vest immediately upon death, creating transmissible hereditary rights in favor of the surviving statutory heirs.
Section 32 marks the statutory gateway to intestate administration. Upon the death of an intestate, no heir has an exclusive claim to any specific asset; rather, each statutory heir acquires an undivided vested share in the net estate after payment of debts, funeral charges, and administration expenses. Litigators must verify that the deceased was subject to Chapter II before formulating any distribution plan under this section.
