Legal Commentary & Landmark Judgments: Section 215

Section 215 regulates the legal effect of a subsequent grant of probate or letters of administration upon a pre-existing succession certificate, superseding the certificate in respect of debts and securities.

  • Automatic Supersession: A grant of probate or letters of administration in respect of an estate automatically supersedes any succession certificate previously granted under Part X.
  • Protection of Past Bona Fide Payments: Bona fide payments made to or recoveries effected by the holder of the succession certificate prior to revocation or supersession remain legally valid and discharged.
  • Surrender of Certificate: The holder of the superseded certificate is legally obligated to surrender the certificate to the issuing court.
Key Landmark Precedents:
  • Chiranjilal Shrilal Goenka v. Jasjit Singh (1993) 2 SCC 507: The Supreme Court affirmed that a grant of probate is a judgment in rem that supersedes summary succession certificates and conclusively establishes the executor's title.
  • State of Bihar v. Radha Krishna Singh (1983) 3 SCC 118: Held that summary certificates under the Act yield to formal testamentary titles granted by a probate court.
Courtroom Practice & Strategic Litigation Guidance:

If a debtor continues paying money to a succession certificate holder after receiving notice of a probate grant, counsel for the executor should cite Section 215; post-notice payments to the certificate holder do not operate as a valid discharge.
