Legal Commentary & Landmark Judgments: Section 13

Section 13 mandates that the Adjudicating Authority, upon admitting an application under Section 7, 9, or 10, must immediately declare a statutory moratorium, cause a public announcement of CIRP, and appoint an Interim Resolution Professional.

  • Immediate Declaration of Moratorium: The Adjudicating Authority shall, by order, declare a moratorium for the purposes referred to in Section 14.
  • Public Announcement Directive: Must cause a public announcement of the initiation of CIRP and call for the submission of claims under Section 15.
  • Appointment of IRP: Must appoint an Interim Resolution Professional (IRP) in the manner specified in Section 16.
  • Same-Day Enforcement: All three statutory directions are typically integrated into the operative admission order passed by the NCLT Bench.
Key Landmark Precedents:
  • Swiss Ribbons Pvt. Ltd. v. Union of India (2019) 4 SCC 17: The Supreme Court noted that the immediate triple-action mandate under Section 13 is critical to freeze all debtor assets, halt asset dissipation, and inform creditors nationwide to lodge claims.
  • Innoventive Industries Ltd. v. ICICI Bank (2018) 1 SCC 407: Affirmed that once default is established and the application is admitted, the NCLT has no discretion to withhold the declaration of moratorium and appointment of IRP under Section 13.
Courtroom Practice & Strategic Litigation Guidance:

Upon admission of CIRP, obtain a certified copy of the Section 13 order immediately. Serve copies on all operating banks to freeze the promoter's cheque-signing mandates, and upload the public announcement on the IBBI website within 3 days.
