Legal Commentary & Landmark Judgments: Section 101

Section 101 governs the statutory moratorium that commences upon the admission of an individual insolvency application under Section 100, halting all debt recovery proceedings for one hundred and eighty days.

  • Moratorium Commencement: A moratorium shall commence on the date of admission of the application under Section 100 and shall cease to have effect at the end of the period of one hundred and eighty days, or upon court approval of a repayment plan under Section 114.
  • Stay on Legal Proceedings: Any pending legal proceeding in respect of any debt shall be deemed to be stayed, and creditors shall not initiate any legal proceedings in respect of any debt.
  • Debtor Disposal Prohibition (Section 101(2)): The debtor shall not transfer, alienate, encumber, or dispose of any of his assets during the moratorium without approval.
  • Applicability to Guarantors: Where the debtor is a partner of a firm, the moratorium applies to the firm; for personal guarantors, protects personal assets from parallel civil attachment.
Key Landmark Precedents:
  • Dilip B. Jiwrajka v. Union of India (2024) 5 SCC 436: The Supreme Court distinguished the full statutory moratorium under Section 101 from the interim-moratorium under Section 96, holding that Section 101 creates a binding judicial stay post-admission to facilitate repayment plan negotiations.
  • State Bank of India v. V. Ramakrishnan (2018) 17 SCC 394: Affirmed that Section 101 provides a structured 180-day freeze on creditor actions to enable collective restructuring.
Courtroom Practice & Strategic Litigation Guidance:

Once an application under Section 100 is admitted, the Section 101 moratorium immediately stays all ongoing recovery suits, DRT recovery certificates, and SARFAESI auctions against the personal guarantor for 180 days.
