Legal Commentary & Landmark Judgments: Section 12

Section 12 enacts a statutory bar prohibiting courts from appointing a guardian for the minor's undivided interest in joint Hindu family property where the property is managed by an adult member of the family.

  • Bar on Appointing Property Guardian: Where a minor has an undivided interest in joint family property and the property is under the management of an adult member of the family, no guardian shall be appointed for the minor in respect of such undivided interest.
  • High Court Inherent Jurisdiction Saved: Nothing in Section 12 affects the inherent jurisdiction of a High Court (Letters Patent) to appoint a guardian in exceptional cases of joint property.
  • Karta's Managerial Prerogative: Preserves the traditional coparcenary management authority of the adult Karta to manage and alienate joint property for legal necessity under Mitakshara law.
Key Landmark Precedents:
  • Sri Narayan Bal v. Sridhar Sutar (1996) 8 SCC 54: The Supreme Court held that under Section 12 r/w Section 8, previous court permission is not required when the Karta alienates joint family property including the undivided interest of a minor for legal necessity or benefit of the estate; Section 8 applies only to separate property.
  • Sunil Kumar v. Ram Parkash (1988) 2 SCC 77: The Supreme Court held that a coparcener, including a minor, cannot maintain a suit for permanent injunction to restrain the Karta from alienating joint family property for legal necessity.
Courtroom Practice & Strategic Litigation Guidance:

In partition or property suits where a minor challenges the Karta's sale of coparcenary land on the ground that court permission under Section 8 HMGA was not obtained, rely on Section 12 and Sri Narayan Bal. Court permission is not required for Karta sales of undivided family interest.
