Legal Commentary & Landmark Judgments: Section 8
Section 8 of the Hindu Adoptions and Maintenance Act, 1956 establishes the capacity of a female Hindu to independently take a child in adoption.
An unmarried woman, a widow, or a divorcee possesses completely unfettered independent capacity to adopt a child in her own name and right without requiring parental or family consent.
Section 8 dismantled the historic doctrine that a woman could adopt only to her husband and with his prior authority. An adoption by a female Hindu under Section 8 makes her the sole adoptive parent, and the adopted child becomes her legal heir under Section 15 of the Hindu Succession Act, 1956, possessing identical succession rights as a biological child.
