Legal Commentary & Landmark Judgments: Section 26

Section 26 establishes the statutory priority of debts contracted by a deceased Hindu over the maintenance claims of dependants under Section 22, protecting bona fide creditors of the estate.

  • Priority of Deceased's Debts: Subject to the provisions of Section 27, debts of every description contracted by the deceased shall have priority over the claims of his dependants for maintenance under Section 22.
  • Estate-Wide Creditor Protection: Creditors holding unsecured or secured debts are entitled to satisfy their debts out of the deceased's assets prior to the distribution of maintenance funds to dependants.
  • Interplay with Section 27 Charge: If a dependant has secured a court decree creating a specific charge on property before the debt is enforced, the charge takes priority under Section 27.
Key Landmark Precedents:
  • Radhabai v. Pandurang AIR 1981 Bom 13: The High Court held that under Section 26, genuine debts contracted by the deceased take precedence over the maintenance of dependants, unless the dependant has had her maintenance specifically charged upon the property under Section 27.
  • Narayan Rao v. Rajani AIR 1990 Kant 256: Affirmed that heirs cannot fabricate fictitious debts to defeat the legitimate maintenance claims of the deceased's dependants under Section 22.
Courtroom Practice & Strategic Litigation Guidance:

To protect a dependant client's maintenance from being wiped out by unsecured business debts of the deceased under Section 26, always pray in the plaint for the creation of an express statutory charge over specific immovable properties of the estate under Section 27.
