Legal Commentary & Landmark Judgments: Section 15

Section 15 establishes the absolute irrevocability and permanence of a valid adoption under HAMA, prohibiting both the adoptive parents from cancelling the adoption and the adopted child from renouncing the adoptive status.

  • Prohibition of Cancellation: No adoption which has been validly made can be cancelled by the adoptive father or mother or any other person.
  • Prohibition of Renunciation: The adopted child cannot renounce his or her status as such and return to the family of his or her birth.
  • Permanent Severance & Transference: The legal severance from the natural family and complete integration into the adoptive family is permanent and irrevocable.
Key Landmark Precedents:
  • Devgonda Patil v. Shamgonda Patil AIR 1992 Bom 189: The High Court held that once a valid adoption is completed under HAMA, subsequent estrangement, misconduct, or repudiation by the parents or child has zero legal effect; Section 15 makes adoption completely irrevocable.
  • N.R. Sreenivas v. State of Karnataka (2007) 14 SCC 69: The Supreme Court observed that the irrevocability principle under Section 15 safeguards the child's identity, stability, and inheritance rights against fickle parental whims.
Courtroom Practice & Strategic Litigation Guidance:

If adoptive parents attempt to execute a 'deed of cancellation of adoption' due to subsequent disputes or criminal complaints, challenge the deed as non-est. Cite Section 15 to show that a valid adoption cannot be cancelled even by mutual consent.
