Legal Commentary & Landmark Judgments: Section 14

Section 14 provides statutory rules for resolving conflicts where simultaneous proceedings for the appointment of a guardian are instituted in two or more courts having concurrent jurisdiction.

  • Concurrent Proceedings Resolution: If proceedings for the appointment of a guardian are instituted in more courts than one, the proceedings in the subsequent court shall be stayed.
  • High Court Determination: Where the courts are subordinate to the same High Court, that High Court shall determine which court shall proceed with the application.
  • Inter-State Resolution: Where the courts are subordinate to different High Courts, the State Governments or High Courts shall resolve the conflict, ensuring the court where the minor ordinarily resides proceeds.
Key Landmark Precedents:
  • Ruchi Majoo v. Sanjeev Majoo (2011) 6 SCC 479: The Supreme Court held that parallel custody proceedings across different courts or countries must be harmonized under Section 14; the court where the child is ordinarily resident holds primary jurisdictional competence.
  • Surinder Kaur Sandhu v. Harbax Singh Sandhu (1984) 3 SCC 698: Affirmed that the jurisdiction of the court is tied to the minor's ordinary residence, preventing forum shopping through tactical child removal.
Courtroom Practice & Strategic Litigation Guidance:

If the opposite party institutes a retaliatory guardianship petition in another district, immediately file an application under Section 14 r/w Section 10 CPC to stay the subsequent proceeding and move a transfer petition before the High Court.
