Legal Commentary & Landmark Judgments: Order 34

Order XXXIV provides the comprehensive procedural code for suits relating to mortgages of immoveable property, governing preliminary and final decrees in foreclosure, sale, and redemption suits.

  • Joinder of All Parties [R. 1]: All persons having an interest either in the mortgage-security or in the equity of redemption shall be joined as parties to any suit relating to a mortgage.
  • Preliminary Decree for Sale [R. 4]: Court passes a preliminary decree directing accounts to be taken, declaring the amount due, and giving the mortgagor 6 months to pay.
  • Final Decree for Sale [R. 5]: Where payment is not made within the period, court on application passes a final decree directing public auction of the property.
  • Redemption Decree [R. 7 & 8]: In redemption suits, court determines balance due and directs reconveyance and delivery of title deeds upon payment.
  • Bar on Collateral Money Sales [R. 14]: Mortgagee obtaining a decree for payment of money on an independent claim cannot sell the mortgaged property without bringing a regular mortgage suit under Order 34.
Key Landmark Precedents:
  • Singh Ram v. Sheo Ram, (2014) 9 SCC 185: The Full Bench of the Supreme Court analyzed Order 34 Rules 7 and 8, holding that in usufructuary mortgages, the right to redeem continues until a final decree debarring redemption or confirming sale is passed; the mortgagor can tender money at any stage before confirmation.
  • J.P. Builders v. A. Ramadas Rao, (2011) 1 SCC 429: The Supreme Court held that Order 34 Rule 1 is mandatory; omitting subsequent encumbrancers or co-owners leaves their right of redemption intact despite court auction.
  • B. Arvind Kumar v. Govt. of India, (2007) 5 SCC 745: Affirmed that a final decree for sale under Order 34 Rule 5 culminates in statutory auction vesting title under Section 65.
Courtroom Practice & Strategic Litigation Guidance:

In mortgage suits, always ensure both a preliminary decree and a final decree are drawn up; an auction sale conducted without first passing a final decree under Order 34 Rule 5 is a jurisdictional nullity.
