Legal Commentary & Landmark Judgments: Section 56
Section 56 of the Code of Civil Procedure, 1908 enacts an absolute statutory prohibition against the arrest or detention of women in civil prison in execution of money decrees.
Section 56 enacts a humane, non-derogable statutory prohibition against the arrest or civil detention of women in execution of money decrees.
The legislative objective is the protection of women from physical arrest and incarceration in pure civil debt controversies. The immunity applies solely to decrees for the payment of money; it does not extend to execution of decrees for specific performance, possession, or injunctions under Order XXI Rule 32, nor does it bar contempt proceedings for willful disobedience of court orders.
In money decree executions against female judgment-debtors, the decree-holder must pursue execution exclusively through attachment and sale of movable or immovable properties, bank accounts, or appointment of a receiver. Any application seeking arrest or civil imprisonment of a woman for money debt is barred ab initio by Section 56.
