Legal Commentary & Landmark Judgments: Section 50

Section 50 governs the execution of a decree against the legal representatives of a deceased judgment-debtor, limiting liability strictly to the extent of the property of the deceased which has come into their hands and has not been duly disposed of.

  • Execution Against Legal Representatives: Where a judgment-debtor dies before the decree has been fully satisfied, the decree-holder may apply to the court which passed it to execute the same against the legal representative of the deceased.
  • Limited Liability Ceiling: Where the decree is executed against such legal representative, he shall be liable only to the extent of the property of the deceased which has come to his hands and has not been duly disposed of.
  • Personal Liability Exception [Sec 50(2)]: If the legal representative fails to satisfy the court that he has duly applied the inherited property, the decree may be executed against him personally to the extent of the property unaccounted for.
  • No Personal Arrest: A legal representative cannot be committed to civil prison in execution of a money decree against the deceased ancestor.
Key Landmark Precedents:
  • Prithi Nath Singh v. Suraj Ahir, AIR 1963 SC 1041: The Supreme Court held that under Section 50, legal representatives are not personally liable for ancestral debts; liability is confined strictly to the assets inherited from the deceased judgment-debtor.
  • Pannalal v. Mt. Naraini, AIR 1952 SC 170: The Supreme Court authoritatively analyzed Section 50 read with Section 53, holding that ancestral property in the hands of sons is liable for non-immoral father's debts under Hindu law up to the value of the estate.
  • Kailash v. Nanhku, (2005) 4 SCC 480: Affirmed the procedural mechanism for impleading legal heirs under Section 50 in execution proceedings.
Courtroom Practice & Strategic Litigation Guidance:

When executing a money decree after the debtor's death, file an application under Section 50 attaching specific inherited bank accounts or real estate; the legal heirs cannot be arrested, but their inherited properties are fully attachable.
