Legal Commentary & Landmark Judgments: Section 17
Section 17 of the Code of Civil Procedure, 1908 creates an exception to the strict local venue rule of Section 16, allowing a plaintiff to institute a suit respecting immovable property situated across different judicial jurisdictions in any single court within whose local limits any portion of the property is located.
When executing a decree passed under Section 17 against properties located in foreign districts, the trial court executes against local property directly and transmits the decree under Section 38, Section 39, and Order XXI Rule 3 to the respective sister courts for execution against the extraterritorial parcels. Practitioners must ensure proper aggregate court fees are paid on the consolidated plaint.
