Legal Commentary & Landmark Judgments: Section 69
Section 69 of the Indian Contract Act, 1872 provides for the reimbursement of a person who pays money which another was bound by law to pay, and who has an interest in the payment.
Section 69 is frequently invoked in property transactions where a tenant or mortgagee pays outstanding municipal property taxes or electricity arrears to prevent disconnection or public auction, subsequently suing the defaulting owner for full reimbursement.
